Penspoke Terms of Use
Last updated: October 4, 2026
These Terms of Use are an agreement between you and H4CF2, LLC, which operates Penspoke, a LetterCircuit app. By creating an account or using Penspoke, you agree to these Terms. If you do not agree, do not use Penspoke. You must be at least 18 years old and able to form a binding contract.
1. What Penspoke does
Penspoke writes a real greeting card for you and mails it. You choose a card front and write a message, we write it with a pen plotter in real ink, and we hand it to the United States Postal Service to deliver to the recipient you name. We are a software and fulfillment service; we are not the postal carrier.
2. Your account
You need an account to order. You are responsible for what happens in your account and for keeping your sign-in secure. Tell us promptly if you think someone else has used your account.
3. Price, postage, and payment
Each card is $4.99 plus postage. Postage for delivery within the United States is $1.31 per card. Postage to Canada or Mexico is $2.24 per card. The exact price and postage for your order are shown before you approve it, and a later change never affects an order you have already approved. Payment is handled by Stripe; we do not store your full card number. Prices may not include taxes you owe.
4. Approving and cancelling an order
When you approve an order, you authorize us to write and mail it with the message, recipients, and style you chose. You can cancel a card any time before we start writing it; once a card is written it cannot be cancelled, because it is already written and prepared for mailing. If you delete your account while a card you paid for has not yet been written, we pause that order during the 30-day account-recovery window and do not write or mail it; if your account is then permanently deleted, we cancel the unwritten order and refund what you paid for it.
5. No recall after writing
Once your card is written, it cannot be recalled, changed, or stopped. Please check your message, your recipient, and the address before you approve.
6. Reprints and refunds
If your card arrives damaged, or we make a mistake writing or addressing it, contact us and we will reprint and remail it at no charge, or issue a refund. We do not refund a card once it has been written for reasons outside our control, such as a postal delay or non-delivery, an address you gave us that was wrong or undeliverable, or the content you asked us to write. This does not limit any refund rights you have under the law.
7. What you may send
You are responsible for the message you ask us to write and mail. You agree not to use Penspoke to send content that harasses, threatens, or defames anyone, that is unlawful or promotes unlawful activity, that misrepresents who is sending it, or that you do not have the right to send to the recipient. We may refuse or decline to write any card we reasonably believe breaks these Terms or the law.
8. Your content
You keep all rights to what you provide: your message, any image you upload, and your recipient details. You give us permission to store and use them only to write and mail your card and to keep a record of your order. You confirm you have the right to give us each recipient's details and to have us mail them. While your account is open, we keep the recipient details, billing details, and your message on your order so you can see your order history. When you delete your account, we remove those details and keep only a redacted record of the order and payment, for seven years from the date of the order to meet our tax, accounting, and legal obligations, and then delete it. How we handle your information is described in our Privacy Policy.
9. Service "as is" and our liability
Penspoke is provided "as is." To the fullest extent the law allows, we disclaim warranties and we are not liable for indirect or consequential damages. Our total liability for a claim will not exceed the greater of what you paid us for the cards the claim is about, or what you paid us in the twelve months before the claim.
10. Governing law
These Terms are governed by the laws of the State of California. The venue for any dispute is the state and federal courts in Alameda County, California.
11. Changes and contact
We may update these Terms and will update the "Last updated" date for a material change. Questions about these Terms: you can reach us through the contact form at penspoke.com/contact.
